These Terms and Conditions (the “Terms”) represent an agreement between Mayank Chawla Menswear, located at 4/20, East Punjabi Bagh, New Delhi -110026 (referred to as “we,” “us,” or “our”), which operates the website www.mayankchawla.co.in (the “Platform”), and you, the user of this Platform (referred to as “you” or “your”). By accessing and using the Platform or engaging with any services, functionalities, or offers made available through it, you agree to be bound by these Terms.

1.4 This document is an electronic record under the Information Technology Act, 2000, and does not require any physical or digital signatures.

1.5 We grant you a limited, revocable permission to use the Platform solely for browsing, selecting, and purchasing Products.

1.6 By agreeing to these Terms, you confirm that you are 18 years of age or older, or if you are under 18, that you have parental or legal guardian consent to use the Platform. If you are acting on behalf of a company or organization, you represent that you have authority to do so.

2. Registration of Your Account

2.1 To purchase Products or access services on the Platform, you must complete a one-time registration, which includes mobile/email OTP verification. After successful registration, you can log in and place orders.

2.2 You are responsible for the security of your account login details. You must ensure that no unauthorized access occurs. You must notify us immediately if you suspect any unauthorized use of your account.

2.3 We are not liable for any loss or damages caused by your failure to protect your login credentials.

3. Communication and Unsubscription

3.1 By agreeing to the Terms, you consent to receiving promotional communications via SMS, email, or other means, even if your contact number is registered under DND or NCPR regulations.

3.2 You can unsubscribe from marketing communications at any time by following the instructions in the received messages.

4. Disclaimer of Warranties, Inaccuracies, or Errors

4.1 While we make efforts to ensure the accuracy of the information on the Platform, we do not guarantee its completeness or correctness.

4.2 You use the Platform and its content at your own risk. We are not responsible for any loss or damage arising from reliance on the information on the Platform.

4.3 Visual representations of Products on the Platform may not always exactly match the delivered Product. Product prices and descriptions may also change without prior notice.

4.4 The Platform is provided "as is," without any warranties, express or implied, regarding the products, services, or content provided. We are not liable for any direct, indirect, incidental, or consequential damages arising from the use of the Platform.

5. Availability and Accessibility of the Platform

5.1 The Platform is controlled and operated from India. If you access the Platform from outside India, you are responsible for complying with local laws.

5.2 We may cancel or redirect orders if users from one region try to order products from another region where those products are not available.

7. COPYRIGHTS IN MAYANK CHAWLA MENSWEAR CONTENT

7.1 The Mayank Chawla Menswear platform includes material such as text, graphics, and sound that is protected by copyright and/or other intellectual property rights ("Mayank Chawla Content"). All copyright and other intellectual property rights in the Mayank Chawla Content are either owned by us or licensed to us by the respective owners to be used on the platform. We retain copyright over all information, including text, graphics, and sound, and all trademarks displayed on the platform are either owned by or licensed to us.

7.2 You are permitted to use and display the Mayank Chawla Content solely on your personal computer for personal use, subject to a limited, revocable, personal, non-exclusive, and non-transferable license granted by us when you register on the platform. This is for identifying products, completing purchases, and printing copies of the content for personal use only. Storage of files on your computer is also permitted for personal use, not for business purposes.

7.3 You may not:

(d) Remove any copyright, trademark, or other intellectual property notices from any content copied or printed from the platform;
(e) Link to any material on the platform without our express written consent.

7.4 The license granted to you does not include:

(a) Resale or commercial use of the platform or Mayank Chawla Content;
(b) Collection and use of product listings, descriptions, or prices;
(c) Use of the platform, services, or content in any manner not intended in these Terms of Use;
(d) Downloading or copying login credentials;
(e) Use of data mining, robots, or similar data extraction tools;
(f) Creating or publishing your own database featuring parts of the platform.

8. TRADEMARKS

All trademarks, including product names and logos associated with Mayank Chawla Menswear, are trademarks or registered trademarks of us or our affiliates. Our trademarks must not be used in connection with any product or service that is not ours.

9. LICENSE AND USE OF YOUR CONTENT

9.1 You grant us a royalty-free, perpetual, irrevocable, non-exclusive right and license to adopt, publish, reproduce, disseminate, transmit, distribute, copy, use, create derivative works from, and display any material you post on the Mayank Chawla Menswear platform. 10.4 You are prohibited from sharing or uploading content that:
(a) Infringes on another person's rights;
(b) Is harmful, defamatory, obscene, or violates any laws;
(c) Contains viruses or malicious code.

PART B – TERMS AND CONDITIONS OF SALE 

• Offer and Acceptance: Placing an order constitutes an offer to purchase, and receipt of an order confirmation doesn’t signify acceptance.
• Returns and Cancellations: Once an order is placed, it cannot be returned or cancelled. Any queries about this can be directed to the support team.
• Multiple Shipments: If an order is dispatched in multiple packages, each will be treated as a separate sale contract.
• Personal Use: Products are for personal use, not resale or business purposes.
• Order Conditions: Orders are subject to product availability and continued adherence to the terms of sale.

Availability info is provided on the product page, but dispatch estimates aren’t guaranteed.

3. Product Pricing

Prices include applicable taxes and may fluctuate before an order is finalized. Adding items to the cart doesn’t lock in prices.
